Obligations of Members Using Paid Services By registering for Paid Services, Users agree to the following: • Accurate Information: Members are required to provide accurate, current, and complete information as requested during the registration process. • Update Obligations: Members must promptly update and maintain the accuracy of the information provided to ensure it remains current, complete, and reflective of any changes. Failure to comply with these obligations may result in the suspension or termination of access to the Paid Services and other applicable legal remedies. 5. Acceptance of Terms By using this Website, you acknowledge that you have read, understood, and agreed to these Terms of Usage in their entirety. By accepting these Terms of Usage, Users expressly and unconditionally consent to the Website arranging calls to their registered mobile numbers, irrespective of whether such numbers are registered under the Do Not Disturb (DND) service provided by their respective mobile service providers. This consent is provided in compliance with applicable laws and regulations governing telecommunication and user consent. Website Content 1. Product-Related Refunds 2.1 Damaged Products • No refunds will be processed for damaged products once delivered. The User is solely responsible for any damage caused post-delivery. For Cash on Delivery (COD) orders, Users returning products will be charged the displayed cost along with shipping, customs, or courier fees. 2.2 Pro-Rata Refunds • In cases of delay in activating subscription services or damage caused during product transit, the Website may consider refunds on a pro-rata basis. Such refunds will be handled in collaboration with shipping and courier agencies. 2.3 Reference Images • Product images displayed on the Website are for reference purposes only. The User is responsible for ensuring the availability and connectivity of their registered contact number. 4. Transaction-Related Refunds 4.1 Deductions from Refunds • Refunds, if processed, will be subject to the deduction of applicable transaction fees, including: 1. Bank charges or Payment Gateway fees. 2. Shipping, courier, or customs duties incurred during delivery. 3. Other expenses borne by the Website in processing the order. 4.2 Server or Payment Issues • If the Website or Payment Gateway experiences server- related issues (e.g., slow performance, session timeout), Users must verify whether their bank account has been debited before initiating a second payment. 1. If the account has been debited, the User should avoid making duplicate payments and contact customer care for confirmation. 2. If the account has not been debited, the User may initiate a fresh transaction. 4.3 Refund for Duplicate Payments • In cases of duplicate payments for the same order, refunds will be issued in full for the additional payment(s), without deduction of transaction fees. The User affirms that they are an individual acting in a personal capacity and not on behalf of a corporation or any other legal or business entity unless explicitly permitted by the Website. The User’s rights to access and use the services offered by the Website are strictly personal, non- transferable, and subject to compliance with these terms. General Obligations of the User While accessing or interacting with the Website, including its forums, features, and products, the User must act responsibly and refrain from violating any applicable laws, regulations, or the rights of others. The User agrees to abide by the following obligations: 1. Intellectual Property Disputes 5.1 Jurisdiction for IP Disputes In addition to arbitration, the parties agree to submit any disputes related to actual or threatened infringement, misappropriation, or violations of intellectual property rights (including copyrights, trademarks, trade secrets, or patents) to the jurisdiction of the courts located in Jaipur, Rajasthan. 5.2 Equitable Relief The parties retain the right to seek injunctive relief or other equitable remedies in a court of competent jurisdiction to prevent harm or enforce rights related to intellectual property.
